Términos y Condiciones

USHU JOURNEY’S TERMS AND CONDITIONS (2025).

GENERAL CONSIDERATIONS

Our experiences/tours are designed for people who want to explore Mexico through its flavors and/or visit its streets, museums, archaeological sites, etc., in a fun way.

Our gastronomic experiences/tours are designed for people with palates open to trying all types of foods; however, while we can accommodate vegetarian diets, we do not guarantee a vegan option. Please note that food may be prepared using the same utensils. Inform us of any dietary restrictions when making your reservation and mention it to your host at the start of your experience/tour.

Before starting the experience/tour, particularly to archaeological sites, please inform us if there are any mobility limitations or other relevant details to ensure your experience is planned according to your needs or to alert you if it may not be possible to participate for the stated reasons, thereby safeguarding your safety.

Before starting the experience/tour, it is important to inform us of the ages of all participants to allow for special considerations when planning your event. Note that, in the case of gastronomic tours, there may be visits to a cantina or pulquería, where minors are not allowed. Event Schedule and Duration

Our experiences/tours begin at the indicated or agreed-upon time. Given the unpredictable traffic in Mexico City, we ask that you take precautions to arrive punctually, aiming to be at the meeting point 10 minutes before the start time. Late arrivals cannot be rescheduled to avoid impacting the experience of other participants, and no refund will be given. Please note that our experiences/tours have a minimum duration of 3 hours and a maximum of 8 hours.

Dress Recommendations

We suggest casual clothing and comfortable shoes, especially for tours in archaeological sites. We do not recommend jewelry or luxury items that may draw attention and could put you at risk. We recommend bringing an umbrella or hat and sunscreen.

Weather

Our commitment is to provide the contracted experience/tour unless extreme weather conditions necessitate its suspension.

Gastronomic Experiences/Tours

What we describe as tasting is considered in appropriate portions as recommended by your host, calculated to satisfy our clients while allowing them to enjoy all options on the tour. Our hosts may suggest additional portions or encourage trying spicy foods, at each participant’s discretion.

All establishments or tasting options included in the experiences have been visited and tested by representatives of our company on various occasions, ensuring that quality and cleanliness are checked. However, for individuals with sensitive diets, Mexican food may generally be spicy, so please exercise caution if this applies to you.

If the service includes “Pick up or drop off” (airport transfer), the itinerary will be confirmed 72 hours in advance, and no changes can be made thereafter.

Our Hosts

USHU JOURNEYS is comprised of a team of tourism and gastronomy professionals (as applicable) with a deep passion for Mexico’s history, culture, and gastronomy. For more information or to learn about their professional profiles, please request it, and we will gladly provide it.

CANCELLATION POLICIES

Sales are non-refundable and may be rescheduled if we have availability on the requested new date. Full payment for the event must be completed 7 days before the start of the experience(s).

Cancellations must be received in writing to ari@ushujourneys.com and contac@ushujourneys.com. For cancellations with at least 7 days' notice, 50% of the payment will be refunded. After that time, no refund will be issued.

Cancellation by USHU JOURNEYS

If, for any reason, USHU JOURNEYS must cancel the experience/tour, you have the option to reschedule or request a full refund, which will be processed promptly. It is important to mention that, given specific circumstances, certain changes may be made to the contracted experiences/tours, which will be communicated in due time.

LEGAL INFORMATION

The payment and/or submission of the deposit receipt or electronic transfer to ari@ushujourneys.com and contac@ushujourneys.com constitutes and formalizes the participant's/client's acceptance of all the terms and conditions stipulated in this document for the contracted experience/tour. Thus, it is the responsibility of each participant to read and understand USHU JOURNEYS' terms and conditions before making a payment.

USHU JOURNEYS reserves the right to request any client to leave the tour at any time if they do not maintain proper conduct, disrespect the host/guide or any group member, or otherwise disturb the group’s order or endanger the host and group’s safety. A client expelled for any of these reasons will not receive a refund or credit. USHU JOURNEYS reserves the right to accept or reject the participation of any client at its discretion without external cause, to maintain the tranquility, order, peace, and safety of the group and the experience/tour itself, without this constituting or being interpreted as discrimination. USHU JOURNEYS reserves the right to report any client who endangers the safety and integrity of the host, driver, and participants to the relevant authorities.

In the event of disputes arising from the experience/tour, the parties agree to make their best efforts to resolve them by mutual agreement, possibly assisted by a mediator. If the parties cannot reach a mutual agreement within 30 calendar days from the date a party informs the other in writing of its intent to resolve the dispute under this paragraph, the parties submit to the jurisdiction of the competent courts in Mexico City, Mexico.

Waiver of Liability

I agree that USHU JOURNEYS, the hosts, guides, employees, and members do not own or operate any entities that provide or are provided by third parties for my experience/tour, including food suppliers, and thus USHU JOURNEYS, the hosts, guides, employees, and members have no responsibility for any act or omission by supplier entities or third parties that may cause harm to the participant, whether due to fault, negligence, or intentional act by those entities or third parties.

I acknowledge that I am participating in the experience/tour covered by this payment at my own risk and with no liability to USHU JOURNEYS. I do so aware of the inherent risks and dangers, including but not limited to: risks associated with the way the tour is conducted or the predetermined stops from start to finish; physical exertion for which I may not be prepared; forces of nature; consumption of alcoholic beverages; risks associated with the consumption of certain foods or drinks; civil disturbances; terrorism; criminal activity; accidents or illnesses without access to quick evacuation or medical services; the quality of medical services received; damages; thefts; losses; or property confusion.

In short, USHU JOURNEYS will not be liable for any incident or act that may cause harm or injury to the participant/client, such as those arising from natural events, acts of war, planned or accidental attacks. USHU JOURNEYS will not be liable for damages or losses, including personal or business property, that the participant/client may suffer in restaurants, markets, businesses, archaeological sites, museums, or any establishment of any external supplier, nor for damages that I or any of my companions may cause to heritage sites in archaeological, natural, or museum areas or any site during the experience/tour.

In case of medical emergencies, they will be handled with the provided contact and the appropriate services deemed necessary, without liability to USHU JOURNEYS or any of its members. Expenses incurred for a medical need or emergency or any of the aforementioned causes, among others, will be the participant’s/client’s sole responsibility, releasing USHU JOURNEYS and its members to the fullest extent from any hypothetical obligation to compensate.

I clearly understand and am aware that I assume responsibility for my own care, wellbeing, and property, as well as, in the case of minors in the group, the responsibility to watch over them, and I accept any and all risks of delays, damage, malfunctions, unexpected events, inconvenience, illness, injury, emotional trauma, or death, releasing USHU JOURNEYS and its members to the fullest extent from any hypothetical obligation to compensate for damages to myself and my companions or my property, or death, due to assumed risks.

I accept that my participation in USHU JOURNEYS’ experience/tour is at my own responsibility and risk, and I agree to the legal enforcement of this Waiver of Liability, which is an integral part of these Terms and Conditions. Here I release and discharge USHU JOURNEYS from any alleged legal liability, whether civil, criminal, or otherwise, for my voluntary and free participation.
