El presente documento constituye el Aviso de Privacidad para efectos de lo dispuesto en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, en adelante “LFPDP”, así como las disposiciones que emanan de ella o se relacionan con la misma. Este Aviso de Privacidad, en lo sucesivo referido como “Aviso”, aplica a la información personal recopilada sobre el Titular por Ushu Journeys, como marca comercial. El responsable recolecta información que puede identificarle de manera razonable, por ejemplo, a título enunciativo mas no limitativo: su nombre y apellidos; fecha de nacimiento; domicilio; dirección de correo electrónico; número de teléfono fijo y/o celular; clave de Registro Federal de Contribuyente -RFC-; número de tarjetas y/o cuentas, razón o denominación social, etc.
La recolección de datos personales podrá efectuarse, por ejemplo:
• Mediante el uso de correos electrónicos y en reuniones que sostengamos con usted de forma personal;
• Cuando se comunica vía telefónica con nosotros;
• Mediante el uso del sitio web del responsable;
• Mediante el suministro voluntario de información a través de las ventanas de diálogo habilitadas en los sitios web y/o redes sociales del responsable;
• Mediante el uso de herramientas de captura automática de datos;
• Mediante la recopilación directa; y/o;
• Mediante fuentes de acceso público y de otras fuentes disponibles en el mercado. Toda la información que recolectamos sobre usted puede combinarse para ayudarnos a adaptar nuestras comunicaciones con usted y desarrollar productos y servicios nuevos o mejoras a los que ya prestamos, en atención a sus necesidades y preferencias. Algunos ejemplos de las finalidades de la información que recopilamos, son:
• Utilizamos la información que recopilamos para brindarle y ofertarle los productos y servicios que solicita, para informarle acerca de otros productos y servicios ofrecidos por el responsable y para administrar nuestros sitios y servicios;
• También para realizar estudios sobre datos demográficos, intereses y comportamiento; estudios de mercado y de consumo a efecto de adquirir y ofrecer productos y servicios personalizados, así como publicidad y contenidos más adecuados a sus necesidades;
• Con el objeto de poder entregar productos, servicios y soluciones, el responsable y/o sus encargados han celebrado o celebrarán diversos acuerdos con proveedores tanto en territorio nacional como en el extranjero, para que le suministren los productos y/o servicios ofrecidos por el responsable, en el entendido de que dichos proveedores están obligados a mantener la confidencialidad de los datos personales suministrados y a observar el presente Aviso de Privacidad;
• Las demás finalidades que resulten necesarias para la relación jurídica entre las partes. Para cualquier comunicación acerca de nuestro Aviso de Privacidad, por favor contacte a nuestro Departamento de Datos Personales, de lunes a viernes, en un horario de 10:00 a 17:00 hrs.
cancellation policy
Sales are non-refundable and can be rescheduled if the requested date is available. Cancellations must be received in writing at contact@ushujourneys.com. Cancellations made at least 72 hours in advance will receive a 50% refund. After this time, no refunds will be issued.
Cancellation by Ushu Journeys
If for any reason USHU JOURNEYS is forced to cancel the experience/tour, you have the option to reschedule or request a full refund, which will be processed promptly. It is important to mention that, given the specific circumstances, certain changes may be made to the booked experiences/tours, which will be communicated promptly.
Legal information
Payment and/or sending the deposit receipt or electronic transfer via email to contact@ushujourneys.com constitutes and formalizes the participant/client's consent to all the terms and conditions stipulated in this document for the experience/tour booked. Therefore, it is each participant's responsibility to read and understand USHU JOURNEYS' terms and conditions before making payment.
USHU JOURNEYS reserves the right to request that any client leave the tour at any time if they fail to comply with the appropriate code of conduct, or who has been disrespectful to the host/guide or any person in the group, or whose presence disrupts order or endangers the safety of the host and the group. A client expelled for any of these reasons will not receive a refund or credit. USHU JOURNEYS reserves the right to accept or reject the participation of any client at its discretion without any apparent external cause, in order to safeguard the tranquility, order, peace, and safety of the group and the experience/tour itself. This does not constitute or may be understood in any way as discrimination. USHU JOURNEYS reserves the right to turn over to the relevant authorities any client who endangers the safety and integrity of the host, the driver, and the participants.
In the event of any disputes arising from the experience/tour, the parties agree that they will make every effort to resolve them by mutual agreement, and may be assisted by a mediator. Should the parties fail to reach a mutually agreed-upon solution within 30 calendar days from the date one party notifies the other in writing of its intention to resolve the dispute under the terms of this paragraph, the parties submit to the jurisdiction of the competent courts of Mexico City, Mexico.
Disclaimer
I agree that USHU JOURNEYS, the hosts, guides, employees and their members, do not own or operate any of the entities that provide or are provided with goods and services by third parties, for my experience / tour, including food providers, so USHU JOURNEYS the hosts, guides, employees and their members, do not have and will not have responsibility for any act or omission of the supplier entities or third parties that could cause harm to the participant, whether or not due to fault, negligence or deliberate act committed by said supplier entities or third parties.
I acknowledge that I have applied to participate in the experience/tour covered by this payment at my own risk and without liability to USHU JOURNEYS. I have done so with knowledge of the risks and dangers involved, including, but not limited to: risks due to the manner in which this circuit is conducted or the arrangements and stops pre-arranged for it from start to finish; physical exertion for which I am not prepared; forces of nature; consumption of alcoholic beverages; risks associated with the consumption of certain foods or beverages; civil disturbances; terrorism; criminal activity; accidents or illnesses without measures of access to rapid evacuation or medical services available; the assertiveness of the medical services received; damage; theft; loss; or confusion of property.
In short, USHU JOURNEYS will not be liable for any event or act that may cause harm or damage to the participant / client, such as those arising from acts of nature, acts of war, planned or circumstantial attacks. USHU JOURNEYS will not be liable for damages or losses, including personal or commercial property, suffered by the participant / client in restaurants, markets, commercial establishments, archaeological sites, museums or establishments of any other external provider, damages that I or any of my companions cause to the heritage in archaeological, natural areas or museums or at any site during the experience / tour.
Medical emergencies will be handled through the contact information provided and with the appropriate services deemed appropriate at the time, without liability for USHU JOURNEYS or any of its members. Expenses incurred due to a medical need or emergency, or for any of the aforementioned causes, including but not limited to others, will be the direct responsibility of the participant/client (100%). USHU JOURNEYS and its members are hereby released, in the broadest terms, from any supposed duty to compensate/repair/indemnify.
I declare that I am clearly and consciously aware that I assume implicit responsibility for my own care and that of my companions, their well-being, and their property; and that in the event that there are children in the group, it is the client's responsibility to look after them; and I accept any and all risks for delays, damages, defects, unexpected events, inconveniences, illnesses, injuries, emotional trauma, or death, hereby releasing USHU JOURNEYS and its members, in the broadest terms, from any supposed duty to compensate/repair/indemnify for damages to my person and companions or to my property, or death, due to said assumed risks.
I agree that my participation in the USHU JOURNEYS experience/tour is at my own risk, and I agree to the legal application of this Disclaimer, which forms an integral part of these Terms and Conditions. I hereby release and discharge USHU JOURNEYS from any alleged legal liability, whether civil, criminal, or of any other nature, for my free and voluntary participation.

Personal Data Department
Data Subjects have the right to request information from the controller about the data we hold about you (right of access); they can also request that your information be updated, whether because the information we hold is incomplete or inaccurate (right of rectification); they also have the right to request that we delete your information from our records or databases if they believe it is not being used in accordance with the principles, duties, and obligations set forth in the regulations (right of erasure); and they can object to the use of their data for specific purposes (right to object). The rights listed are known as ARCO rights. To receive, record, and process requests to exercise your right to access, rectify, erase, and object to your Personal Data, as well as to limit the use or disclosure of your data, pursuant to Article 29 of the LFPDP (Spanish Law on Personal Data Protection), we ask that you send a request for access, rectification, erasure, or objection by sending an email to the Personal Data Department of Ushu Journeys, as a trademark, to the following address: contact@ushujourneys. In your request, you must include: your full name (data subject) and an email address for the purpose of communicating your response; a scanned and/or digital image of a document proving your identity; a clear and precise description of the personal data for which you wish to exercise any of the aforementioned rights; and any other information or document that facilitates locating the personal data.
Ushu Journeys, as a trademark, reserves the right to periodically update this Notice to reflect changes in our information practices. It is the Owner's responsibility to periodically review the Notice on the website www.ushujourneys.com, where any changes will be posted along with the date of the most recent update.
